Rwanda: Supporters of scholar Léopold Munyakazi struggle to stop his deportation from the U.S.

French professor Léopold Munyakazi is in custody in Miami, on the verge of deportation, as friends, family, and a pro bono attorney struggle for his release.

KPFA Weekend News Anchor: Supporters of suspended Gaucher College French Professor Léopold Munyakazi are urgently trying to stop his deportation to Rwanda because they feel it would lead to his Professor Léopold Munyakazi secured a job teaching French at Gaucher College with the help of an organization called 'Scholars in Danger,' but the college suspended him after the Rwandan government's allegations. imprisonment, torture and/or death. The Rwandan government accused Professor Munyakazi of genocide after he made several speeches in which he said that the Rwandan massacres that took place between 1990 and 1994 were not genocide. He said instead that Rwandans are one people sharing the same language and culture and that the war and massacres grew out of a long smoldering class conflict in which the social classes were labeled as Tutsi, Hutu, and Twa.  
 
Professor Munyakazi's case is still pending in the Fourth Circuit Court of Appeals, but Department of Homeland Security professionals arrested him last week anyway. KPFA's Ann Garrison spoke to attorney Ofelia Calderón. 

KPFA/Ann Garrison: Ofelia Calderón, what happened to Professor Léopold Munyakazi last week?  

Ofelia Calderón: The DHS picked him up, or ICE, the police of the DHS, picked him up at his home on Friday, September 4th, at 3 pm and took him into custody, and moved him from Baltimore to Louisiana to Miami, which is the classic staging step for deportation. He's always reported, and he's been on an ankle bracelet, so there's really no other reason to pick him up except to deport. 

KPFA: What do you think the underlying political context of this is? 

OF: I believe that the Rwandan government has been negotiating with the U.S. government to extradite individuals that they want to charge with these types of crimes, with genocide. 

KPFA: And, Professor Munyakazi has been critical of the Rwandan government and its official genocide narrative, right? 

OF: That is true. That's completely accurate. The Rwandan government issued its warrants of arrest for Professor Munyakazi in 2008. It was because he had given two speeches about the genocide and had characterized it differently from the Rwandan regime.  
 
KPFA: He characterized it as a class conflict rather than an ethnic conflict, right? 

OF: That's correct. That's correct. And then coincidentally, they immediately and inbetween issued these warrants alleging that he had been involved in genocide, notwithstanding the fact that years prior evidence had been proffered specifically by witnesses who said that he hadn't been involved.

KPFA: Right, well they couldn't charge him with a speech crime, which seems to be what they're actually exercised about.

OF: To be fair, there was also a charge of genocide negation, and there was also a charge of divisionism.

KPFA: Oh, divisionism, OK. 

OF: Having divisionist ideology. 

KPFA: How did the U.S. courts deal with the speech crime issues? 

OF: Well, I would say that in immigration court, I think that Judge Kessler certainly acknowledged that that was a motive for the Rwandan government to issue their warrants, but at the end of the day, she Immigration attorney Ofelia Calderón, seen here speaking on CNN, so believes in Léopold Munyakazi's innocence that she has been working on it for six years pro bono.accepted the evidence that the Rwandan government had provided to the U.S. government and found that he was a human rights persecutor and, as a result, denied his application for asylum. 

KPFA: There are lot of people working to try to stop this deportation. What are his chances? 

OF: Right now his case is at the Fourth Circuit Court of Appeals. So, what I have done as his attorney is I filed a motion for an emergency stay with the Fourth Circuit, asking that they stay his deportation pending the culmination of the appeal at the circuit court level. An administrative stay was filed with ICE as well by friends and family and individuals that are very supportive of Professor Munyakazi. And there's a lot of pressure, I think, from the public now at this point to, at a minimum, permit him to stay for purposes of completing the appeal.

KPFA: Well, he could appeal all the way to the Supreme Court, couldn't he? 

OF: Absolutely, that's right, but we haven't finished the circuit court point. The opening brief is due September 21st, 

KPFA: And you believe in this case so much that you've been working on it pro bono for four years, right? 

OF: I've been working on it pro bono since 2009. Six years. 

KPFA: OK. What do you think will happen to Professor Munyakazi if he is in fact deported to Rwanda? 

OF: Well, there's no dispute that Professor Munyakazi will be detained upon his arrival in Rwanda. I believe that he will suffer torture. I absolutely believe that. And to some extent, I also believe that. . .I believe his very life is in danger. For purposes of the Rwandan government, he is someone that they do not want to continue speaking.

KPFA: And that was Ofelia Calderón, attorney for Professor Léopold Munyakazi.

Le Royaume-Uni s'oppose à la révision de la Constitution rwandaise

« Le Royaume uni n'est pas en faveur d'une réforme de la Constitution pouvant permettre à Paul Kagame de briguer un troisième mandat ». C'est ce qu'a déclaré Grant Shapps, le ministre d'Etat britannique en charge du développement international et de l'Afrique à l'issue d'une visite de deux jours dans le pays, vendredi 11 septembre. Cette visite intervient deux jours après la désignation d'une commission ayant pour but de rédiger un projet de réforme de la Constitution pouvant permettre au président rwandais de se représenter en 2017.

La Constitution, mais aussi l'arrestation à Londres en juin dernier du chef des services secrets rwandais et la suspension d'une partie des programmes de la BBC à la suite de la diffusion d'un documentaire controversé sur le génocide sur une des chaines du diffuseur britannique ont été à l'ordre du jour de l'entretien que le ministre britannique a eu avec le président Kagame. Des points qui ont été abordés ensuite lors d'une conférence de presse.

« Le Royaume uni a un système judiciaire entièrement indépendant », a déclaré le ministre d'Etat britannique assailli par les questions des journalistes à propos de l'arrestation du général Karenzi Karake à Londres. Autre sujet à controverse abordé lors de cette conférence de presse commune avec le ministre rwandais des Finances : la suspension par Kigali des programmes en kinyarwanda de la BBC. Le sujet a été évoqué avec Paul Kagame et la position britannique est claire.

« Nous croyons que tous les pays dans le monde devraient avoir une presse libre et dynamique, a déclaré Grant Shapps. Nous pensons qu'il devrait y avoir de l'espace pour la société civile. Nous croyons qu'il devrait y avoir de la place pour du débat politique. Nous ne pensons pas que la constitution devrait être amendée ».

Condamnation à demi-mot

Une position de principe qui fait écho à celle des Etats-Unis qui, la semaine dernière, se sont une nouvelle fois prononcés contre un troisième mandatpour Paul Kagame. La condamnation britannique est toutefois moins directe. Le ministre d'Etat Grant Shapps a choisi de mettre les formes, sans condamner directement le Rwanda. Le problème c'est que les choix de Kigali peuvent, selon lui, influencer d'autres pays de la sous-région.

« La difficulté avec les amendements de constitutions est qu'une fois qu'un pays le fait, tout le monde pense pouvoir le faire en retour. Beaucoup de pays voisins n'ont pas les mêmes standards que ceux d'ici. »

Pour les Britanniques, le Rwanda est considéré comme un partenaire vertueux, notamment en matière de gestion de l'aide internationale. Officiellement — du côté britannique comme du côté rwandais —, malgré les « accidents de parcours », les relations entre les deux pays restent solides.

[amakurunamateka] Why the ICTR Refuses to Examine the Assassination that Triggered the Rwandan Genocide

Given its reluctance to investigate the RPF's complicity in the Habyarimana assassination, the ICTR may or may not be able to deliver its promise of providing many of the accused Hutus with their most fundamental right to a free, fair, impartial and independent trial. What is clear, however, is that ICTR is inadvertently putting the UN Security Council in the hot seat by carrying evidence that a) undermines the fraudulent official account of the genocide, b) exposes the role of some UN Security Council members in facilitating the RPF's rise to power, and c) points to the inapplicability of the UN's championed common law and multiparty electoral systems in heterogeneous ethnic settings. As a result, the UN Security Council is left with little choice but to preserve its legitimacy by coercing the rest of the international community into ignoring the evolution of knowledge on the genocide.

This triple threat explains why hardly anyone speaks of the US-­Rwanda connection in not having signed the 1998 Rome Statute that established the International Criminal Court. It also explains why Kagame can claim diplomatic immunity and continue to exercise his hegemonic influence in the Great Lakes region without signing the Rome Statute. Therefore, until diverse nations unite in common cause to revise (rather than sustain) the Hutu extremist narrative, politics most likely will continue to trump justice, bias will trump inquisitiveness, and international public law will remain an inherently slow, informal, and unfair process.

On a more positive note, the rising popularity of alternative news indicates that more dissidents realize they are being lied to by the mainstream media. They know the mainstream press cannot cover up much longer the fact that Western democratic values make no sense in heterogeneous ethnic settings like Rwanda, where the common law system and majoritarian multiparty elections exacerbate ethnic tensions.

The main threat to dissidents around the world remain those progressive and neo-conservative intellectuals who, because they do not grasp the ethnic realities of the African continent, carry on promoting an over-simplified official narrative (via the mainstream press) that justifies the Anglo-American system of imperial domination. Equally threatening are left-wing and right-wing political parties, most of which are subservient to this intellectual elite, that mobilize in the name of human rights, pacifism and universal fraternity while covertly sponsoring corrupt and bellicose heads of state.

Again, people are starting to notice this political trend, which is probably why the US recently warned Kagame not to seek a third term as Rwandan president. What remains to be seen, however, is whether or not the US and the rest of the international community will incriminate Kagame once he no longer has sovereign immunity. This pending decision puts the world at a dangerous crossroads: if the international community does decide to bring Kagame and his men to justice, it will have to go against its own interests either by debunking the Hutu extremist myth and re-writing the official history of the Rwandan Genocide, or alternatively by fabricating yet another lie and further promoting the intellectual enslavement of mankind.
