[amakurunamateka] Kabila says Congo won't bow to foreign 'injunctions'

KINSHASA (Reuters) - The president of Democratic Republic of Congo told foreign nations on Monday to respect his country's sovereignty after several urged him to comply with the constitution and not to run for re-election.

Though Joseph Kabila has yet to publicly declare his intentions, Congo is rife with speculation that he is looking for ways to remain in charge of the vast, mineral-rich nation after his second elected five-year term in office ends in 2016.

"We are always open to the opinions, advice and suggestions of our partners, but never to injunctions," Kabila said during a rare public speech before a joint session of parliament.

Kabila came to power in 2001 when his father, Laurent, was assassinated in the middle of a conflict that sucked in regional armies are killed millions of Congolese.

He steered Congo to post-war elections in 2006 and won re-election in 2011, although the second vote was marred by complaints of widespread irregularities. Congo's constitution currently limits presidents to two elected terms in office.

Senior U.S. officials have already publicly called on Kabila not to alter the constitution in order to hold onto power.

During a summit of French-speaking countries last month, France's President Francois Hollande more broadly cautioned leaders facing constitutional term limits to learn from the example of Burkina Faso.

Mass protests forced Burkina Faso's President Blaise Compaore to step down and flee the country after he tried to push through constitutional changes to extend his 27-year rule.

Congolese opposition leaders have managed to draw thousands of protesters to marches calling for Kabila to step down in 2016.

In his speech on Monday, Kabila criticized what he said was the "systematic tendency" among some of his countrymen to look abroad for assistance to settle domestic political differences.

"There is no crisis in DRC, and even were we to have one we would sit down together around a table to negotiate," he said.

Congo President Calls for UN to Begin Withdrawal

Congo's president urged the United Nations on Monday to start withdrawing from the enormous country where a peacekeeping mission has been based for 15 years.
During a lengthy speech before parliament, President Joseph Kabila asserted that peace is progressively returning to the country racked by back-to-back civil wars. A myriad of rebel groups remain active in the country's east, launching attacks on civilians.
Kabila said the threat posed by various rebel groups "does not justify keeping a contingent of 20,000 men on our soil."
"The time has come to start reducing the number of blue helmets in our territory," he said, referring to the U.N. peacekeepers known for their signature protective gear.
The U.N. peacekeeping mission's mandate is up for renewal again at the end of March 2015.
Critics question whether the Congolese military can adequately protect civilians especially in the conflict-torn east.
More than 250 people have been killed in attacks around the town of Beni in the past two months, according to a local civil society group.
The U.N. peacekeepers first arrived in 1999 to observe a cease-fire and the withdrawal of foreign troops. U.N. force's strengthened mandate to fight rebels is credited with helping the Congolese army to oust a rebel group known as M23 from the country's embattled east a little over a year ago.

[amakurunamateka] Military Operations Against Rwandan Rebels: MONUSCO's Dilemma

On December 8, 2014, MONUSCO head Martin Kobler met with FDLR President Major General Byiringiro, according to sources within MONUSCO. During the meeting, Martin Kobler apparently communicated the following to General Byiringiro:
  • FDLR troops , including all top commanders must disarm by Jan 2, 2015, without conditions.
  • FDLR must hand in all commanders sought by the International criminal court
  • FDLR top commanders, not sought by the ICC, may seek asylum in SADC countries, is they so wish. MONUSCO would facilitate.
  • If the above conditions are not met, military operations will start on January 2, 2015.
According to the sources, Major General Byiringiro did not appeared phased by the ultimatum. After the meeting, he sent out a letter to World leaders, in which he
stated that: "ill-advised approaches have been applied by the international community (i.e. United Nations (UN)) in an attempt to resolve the Rwandan complex problem due to understanding it in very superficial and shallow ways...the international community should not waste its time on that matter[NDLR: resettling Rwandan refugees in a third country] unless if it has an ulterior agenda. It should be noted that Rwanda is our country and as such, it is where all Rwandans must enjoy their fundamental rights. And no one has the right to prevent them from it."
Based on that, it is clear that FDLR may not meet the stern conditions outlined by MONUSCO's head. In that case, the question may then be: what will Martin Kobler do next? 
The answers evolve around the following unknown factors: Beni-Mabu massacres, potential human toll, availability of troops to MONUSCO, and security situation in Rwanda. 

Kobler Martin shackled by the consequences of the Beni-Mabu massacres

MONUSCO has been grappling with what has now become known as "Beni Affair",  due to the perceived inability of MONUSCO to avert or at least stop the large scale massacres of civilians, in the Beni areas, by alleged Ugandan ADF-NALU rebels. The Beni-Mabu repeated massacres may be an additional weight on Kobler Martin's shoulders. All eyes are on him, wondering how he will end the tragedy using the MONUSCO troops.
Efforts so far have failed, and MONUSCO is more and more seen as an inefficient and unable to deal with localized insecurity leading to massacre of civilians. Civilians in Beni and elsewhere in North-Kivu have openly expressed their frustration against MONUSCO. Several local politicians and traditional leaders have also entered the fray. The questions oftern raised are mostly the following:
  •  how MONUSCO will undertake military operations against FDLR and Rwandan refugees, if it is unable to stop ADF-NALU from massacring civilians?
  •  how is Kabila's going to supply troops to hunt down peaceful Rwandan refugees, when ADF killers are roaming free in Beni?
This remains  a critical question, especially after DRC President Joseph Kabila said during his last visit in Beni,  while commenting on the lack of security in North-Kivu,  that "people should not confuse Rwandan rebels with ADF."
 In his state of the country speech, on December 15, 2014, President Joseph Kabila highlighted his hesitation when he questionned the wisdom of "seeking foreigners to resolve Congolese problems, as though Congolese are not able to do it themselves." This is consistent with the DRC government during a ICGLR-SADC meeting in October (see our article:  of October 26, 2014.

Potential civilian toll from military operations

Martin Kobler has an even more serious ethical and moral dilemma: among the so called FDLR and other Rwandan rebels, are 240,000 refugees, mostly women, children, and elderly. How is MONUSCO going to justify military operations against refugees the United Nations is supposed to protect? How will MONUSCO separate civilians from combatants in the Congolese jungles or Rwandan refugees from Congolese nationals?What will happen if most casualties from MONUSCO's military operations and bombings are women and children? 

Troops Availability

Sources with the DRC government have told AfroAmerica Network that Joseph Kabila is opposed to the military operations against Rwandan refugees. Nevertheless, MONUSCO relies on FARDC troops to conduct operations. In fact, SADC, especially Tanzania and South African governments, has apparently told MONUSCO that their troops will not get involved in fighting Rwandan refugees. Joseph Kabila's government has also indicated that the priority for FARDC troops is stopping massacres in Beni-Mabu. The question now is: what troops Martin Kobler will use in military operations against Rwandan rebels and refugees?

Security Situation in Rwanda

Recently, the government of Rwanda has been accused of large scale massacres and assassinations targeting civilians. Countless bodies of Rwandans, believed to be those of perceived opposition members, have been floating in lakes and rivers in Southern Rwanda and Northern Burundi. Several people, espcially the demobilized soldiers, both former rebels and former government soldiers have disappeared.
How is MONUSCO, a United Nations peacekeeping mission, going to force Rwandan refugees and political leaders to return to Rwanda, with a high risk of being massacred or assassinated?
Many questions that will definitely need answers as the January 2, 2015 MONUSCO ultimatum to Rwandan refugees approaches.

After the recent Article that appeared in the Inyenyeri news under the heading " Is Gahima haunted by his Role  in the Rwanda Genocide?"   Theogene Rudasingwa a brother to Gahima responded on his facebook page by demanding an apology from inyenyeri news, in his words Rudasingwa stated that.

"We are yet to reach a stage where we can disagree with civility. Instead of challenging Gahima's arguments, the Inyenyeri News article said he is a thief. Now, being a thief and having ideas are different things. I say this not because Gahima is my brother, or a colleague leader in the RNC, but because I sense unfairness in the Inyenyeri attack. As for debate on BBC documentary, that is precisely its utility. To encourage debate. That means listening first, even if you do not agree.
 
Inyenyeri News has simply disgraced itself by parading the usual shameful Kigali-like hatred against Gahima. The honorable thing to do would be to apologise to Gahima, but as it often said, only those morally responsible can rise to that revolutionary challenge".

We have received different comments against and in support of the above article. However, the most astonishing behaviour by some people as those telling the Inyenyeri news to apologize for allowing the article to be published. This is like telling the African Chiefs that they should not apologize for allowing slavery of their Citizens a hundred years ago.

In unprecedented demand for accountability by some African civil rights defenders the Traditional African rulers were encouraged to apologize for the role they played in the slave trade."We cannot continue to blame the white men, as Africans particularly the traditional rulers, are not blameless," said the Civil Rights Congress.

Could we say that this human rights organization was not civilized because it demanded the accountability of the African Chiefs who helped, aided, assisted, the white man to capture many of their fellow countrymen and take them as slaves?

Should we tell the BBC that allowed this article to appear in its publications on 12, November 2009, to apologize? Who has the monopoly of civilizations when it comes to facts or opinions? The best way of showing civility when it comes to responding to issues in the free speech world forum, is to write and counter argue what you think is incorrect or biased as you might think.

What the Inyenyeri news did was to publish what the writer of the above article thought was a responsibility for the opposition figures to have the moral standing, indeed, to be part of any future constitutional arrangement in Rwanda; there are some historical issues for them to address.

As any prominent public figure, for instance Celebrities, politicians, high-ranking or powerful government officials, and others with power in society will always have a problem in drawing a line between what is personal or private or public.  Why should a public figure that is suspected of theft, become private or vendetta if it comes to accountability? Unless he/she comes with the facts that are contrary to what has been said against him or her. The scales of accountability when it comes to the Rwandan government and the opposition figures should be of the same standard.

As regards, the Inyenyeri news position, we shall never apologize for being fair, impartial, doing our job without fear or favor. Individuals who are considered to be limited-purpose public figures remain so as long as the public has an "independent" interest in the underlying controversy against them. Unlike all-purpose public figures, it is relatively easy for a limited-purpose public figure to lose his status if the controversy in which he is involved has been largely forgotten. But most will still maintain their status even after they leave the public office. Therefore, those who have been in public eyes remain a target as long as there is reason by anyone to bring to life the old memories.
