On Tuesday July 14, a joint session of Rwanda's senate and parliament sat to review a myriad of petitions seeking a constitutional amendment to remove a provision that limits a president to hold office for only two terms. This kicked a buzz on social media.

The general reading on Uganda's social media circuit was that 'Rwanda's parliament had amended the constitution to allow president Paul Kagame seek a third term of office'.

No, they (the senate and parliament) did not do such a thing; and I felt obliged to comment on some Facebook posts correcting that wrong impression. They just opened the debate on the 'small matter' of amending Article 101 of the constitution.

Rwanda's constitution is written in plain English; no winding poetic syntax associated with legal documents. Article 101 of the constitution reads: The president of the republic is elected for a term of seven years renewable only once. Under no circumstances shall a person hold the office of president of republic for more than two terms.
In plain English, 'under no circumstances…' means that even if (IF 3) there were an emergency or there is a threat of mass suicide, the president would still not be allowed to serve for a third term of office.

Well, but now that 'the thing' is open for debate, the 'impossibility' (the grammatical IF 3) of a president serving a third term has been rendered void déjà.

Citing the power of the people, the proponents of the amendment make the issue look like an 'innocent constitutional amendment' devoid of 'politics' and partisan self-interest associated with politics.

Yet the letter and spirit of the more than three million petitions, the basis for this debate, are very clear: amend the constitution so president Kagame can seek another term of office.

In the circumstances, one would not be opposed to president Kagame's continued stewardship of the country. What I am personally opposed to is the 'clever romanticisation' of the masses and their power. Isn't this a non-military popular coup d'etat? Isn't this some kind of Arab spring of sorts?
Now let us ask: What is in issue here? Do the 'people' want president Kagame to be declared life president? Do they want him to serve for a particular number of terms (say, one or two terms)? Should Article 101 be deleted so that 'any' president can hold office for 'any' number of terms (like is the case in Uganda)?

With the petitioners being particular with their demand that Kagame continues to lead the country, will his name be written in the law? How is the referendum question likely to be framed? Does this act of 'people power' have any precedence in Rwanda? Oh yes.

Those with more than an average interest in Rwanda's history may compare this process to the 1961 kamarampaka (referendum) in which Rwandans voted to abolish the Kingdom of Rwanda and adopt the Republic of Rwanda. Yes there was voting. And yes, the republicans won.

But to what end? It is a fact that Rwanda, like Uganda, has never had a peaceful change of government since independence; every government bombs itself into power with some former presidents dying in unpleasant circumstances.
Anecdote:
I challenged people to name all the presidents of the republic of Rwanda. Here: Dominique Mbonyumutwa, Gregoire Kayibanda, Maj Gen. Juvenal Habyarimana, Theodore Sindikubwabo, Pasteur Bizimungu and Maj Gen Paul Kagame.

Right? Wrong; because the presidency of one of the men named above was expunged from public record by courts of law.

Don't laugh…, because the mausoleum holding the mortal remains of another former president, hitherto itemised as one of the national monuments and antiquities, was de-gazetted and the land rendered free for change of use. N'akarusho rero (it's tricky).

Rwandan legislators have voted in support of a referendum that will allow President Paul Kagame a third term in power, backing a petition signed by millions of citizens.

"I want to thank all members of parliament for showing support to the people's wishes," Speaker of Parliament Donatilla Mukabalisa said, after both the lower and upper houses voted in the first step of the process for constitutional change.

The Rwandan constitution, adopted in 2003, limits the number of presidential terms to two, and therefore bars Kagame — elected first in 2003 and again in 2010 — to stand for a third term.

According to parliament speaker Donatilla Mukabalisa, petitions signed by a total of two million people — or roughly 17 per cent of the population — have demanded that Kagame be allowed to stay in office.

The debate on the third term calling for the removal of Article 101 has been largely one-sided, calling on parliament to endorse the processes to amend the Constitution.

Any change to the constitution would require a vote in support by at least three-quarters of both parliamentary houses, followed by a national referendum.

President Kagame is serving his last official term as specified by the Constitution. The Rwandan leader recently said that he is open to going or remaining based on what Rwandans decide ahead of 2017.

The United States on Wednesday reiterated its opposition to a third term for Rwanda President Paul Kagame. 

The US comment, made in response to a query from The EastAfrican, follows the Rwandan Parliament's vote to amend the country's constitution to remove a provision barring a president from serving more than two terms. 

"The United States has consistently called for African leaders across the continent to respect term limits," said Rodney Ford, spokesman for the State Department's Africa Bureau. 

"We do not support changing constitutions to benefit the personal or political interests of individuals or parties." 

Washington said last month in regard to the move to enable Mr Kagame to run again that "democracy is best advanced through the development of strong institutions, not strongmen." The State Department added in June: "We are committed to support peaceful, democratic transition in 2017 to a new leader elected by the Rwandan people." 

Despite apparently broad support in Rwanda for Mr Kagame remaining in office beyond 2017, the Obama administration's disapproval is likely to carry weight for the country dependent on development aid from the US.

State Department officials have also criticised Rwanda's human rights record under President Kagame, who first took office in 2003. 

"Alongside Rwanda's remarkable development progress, there have been equally consistent efforts to reduce space for independent voices and to diminish the ability of the media, opposition groups and civil society to operate," Deputy Assistant Secretary of State Steven Feldstein recently told the US Congress. 

The Rwandan Parliament's move to change the constitution is the first step in a process that also must also involve a national referendum. But the outcome of such a vote would generate little suspense. 

More than half the country's enrolled voters are reported to have signed a petition calling for revision of the article in the constitution limiting a president to two terms.

ARRETER LE PRESIDENT PAUL KAGAME EST LE SEUL MOYEN POUR L'EMPECHER DE BRIGUER UN TROISIEME MANDAT
 
Parce qu'il se croit au-dessus des lois et des institutions du Rwanda, parce que cet homme est prêt à faire payer à son peuple le prix humain le plus fort, à savoir la mort, sans limite dans la durée ni dans le nombre, aucune forme de pression politique pacifique interne ne peut contraindre le Président Paul Kagame à abandonner son projet d'asseoir un Etat totalitaire au Rwanda.
Parce qu'il sait que les sanctions économiques internationales font plus préjudice à la population qu'à l'élite au pouvoir et parce que les Puissances qui imposent de telles sanctions finissent par les lever pour des raisons d'intérêts, le Président Kagame s'en moque éperdument.
Parce que cet homme, qui a pourtant commis des crimes  de guerre, des crimes contre l'humanité ainsi qu'un  génocide sur son peuple, a continué de bénéficier, plus de vingt ans durant, de la plus grande tolérance et compréhension de la communauté internationale et des Puissances qui l'ont aidé à prendre et à asseoir son pouvoir totalitaire, Paul Kagame a fini par croire qu'il pouvait tout se permettre.
Enfin, parce qu'il constate que des Etats comme les Etats-Unis d'Amérique et la Grande Bretagne qui l'ont protégé jusqu'à maintenant, commencent à s'interroger ouvertement, à documenter ses crimes notamment par les hearings actuels par le Congrès américain, à coopérer avec la justice comme par exemple l'arrestation du responsable des services secrets rwandais par la police métropolitaine en vue de son extradition à la justice espagnole, le Général Président sait qu'il n'a d'autre possibilité que de s'imposer à vie comme Président de la République afin de se cacher derrière l'immunité diplomatique que lui confère sa fonction de Chef de l'Etat.
Les gesticulations actuelles de collecte de signatures commandées auprès de la population pour un troisième mandat en faveur du Président  et la décision adoptée en date du 14 juillet 2015 par le Parlement rwandais en vue d'un référendum de changement constitutionnel ne sont qu'une ultime instrumentalisation du vote populaire destinée à lui conférer une présidence à vie, seule potion magique contre l'impunité de ses crimes.
Si le Tribunal pénal international sur le Rwanda – TPIR - a fait un travail important en jugeant les principaux responsables, au sein du régime Habyalimana, de crimes contre l'humanité et de génocide, en revanche il a failli de manière notable en s'abstenant de juger les responsables au même titre, au sein de l'ancienne rébellion aujourd'hui au pouvoir à Kigali. Cet échec du TPIR a pu dès lors être interprété comme un blanc-seing accordé au Président Kagame pour l'approfondissement de la dictature et pour l'exportation de la guerre en République Démocratique du Congo. Il est à noter que cette guerre a déstabilisé la Région des Grands Lacs et a constitué une tragédie majeure jamais égalée depuis la Deuxième Guerre mondiale. Elle a emporté, en effet, la vie de plus de 6 millions de Congolais, a été le théâtre de nouveaux crimes contre l'humanité dont, selon le Rapport Mapping des Nations Unies d'octobre 2010, des « actes de génocide », sur les réfugiés hutu rwandais.
Depuis la publication du Rapport Mapping, plusieurs organisations rwandaises et congolaises tant de la société civile que de la politique, des ONG de droits de l'homme, des experts de la Région des Grands Lacs ont proposé sans succès la mise sur pied d'un Tribunal pénal international ad hoc sur le Congo. En particulier, en août 2013, 52 personnalités féminines d'envergure internationale ont lancé un appel demandant la création d'un Tribunal pénal international pour la République démocratique du Congo. Ce Tribunal était présenté comme "une solution incontournable pour la paix et la justice dans la région des Grands Lacs". En février 2014, l'ambassadeur des Etats Unis en charge de la politique contre les crimes de guerre et crimes contre l'humanité, Monsieur Stephen Rapp, qui se trouve être en même temps l'ancien procureur du Tribunal spécial pour la Sierra Leone qui a obtenu l'accusation et la condamnation du Président Charles Taylor du Liberia, a appelé à la constitution d'un tel tribunal. Toutes ces organisations et personnalités sont d'avis en effet, qu'il convient d'en finir avec l'impunité et œuvrer pour des transitions politiques pacifiques. Il est temps pour la Communauté internationale, les Membres du Conseil de sécurité en particulier, d'écouter toutes ces demandes et d'instaurer un tel tribunal pour juger les responsables des crimes de guerre, des crimes contre l'humanité et des actes de génocide,  qui se sont perpétrés sur le territoire congolais.
La  constitution du Tribunal pénal international sur le Congo, auquel l'immunité de Chef d'Etat ne peut pas être opposée, marquerait un coup d'arrêt contre l'impunité.
Aussi, selon le Mouvement National Inkubiri, l'instauration d'un tel tribunal permettrait à la Région des Grands Lacs d'en finir avec l'entretien de rébellions déstabilisatrices téléguidées depuis le Rwanda et de pouvoir se projeter dans un futur paisible. Enfin, l'inculpation du Président Kagame, dépouillé de son immunité, lui enlèverait le leitmotiv de changer la Constitution en vue de son élection à la présidence de la République en 2017.
Le Mouvement National Inkubiri estime que, en lieu et place du concert des rodomontades actuelles appelant le Président Kagame à renoncer à un troisième mandat, le moyen le plus efficace d'arrêter les aventures d'un homme déterminé à instaurer un pouvoir autoritaire à vie sur les Rwandais et à déstabiliser la Région des Grands Lacs, voire au-delà, est de l'arrêter et de le traduire devant la Justice internationale. Le Tribunal pénal international ad hoc sur le Congo constituerait cette opportunité.
