Ikibazo cy'urwanda mbere yuko kiyongeraho icya genocide, cyari ukudatandukanya politike n'amoko nuturere, byabyariye abaturage bose akarengane.

Ubu Rwanda nicyo gihugu gifite imbaga mu bihugu byose, muli Afrika, Uburayi, Amerika, aho prezida wacu ajya agaserukirwa, nk'uku nyine Urunana rwo mu Busuwisi rwabigize. 

Kandi abanyarwanda ntibigera bibagirwa n'abo basize inyuma: mwibuke bimwe bwana Yozefu Ngarambe yatubwiye, ko iyo mbaga yo hanze yoherereza abasigaye i Rwanda arenze 250 000 000 $ US buli mwaka!

Ni byiza rero.

Le gouvernement du Front Patriotique rwandais persiste et intensifie la pression pour se voir confier les Archives du TPIR. Cette démarche est loin d'être anodine. Il convient de rappeler l'importance capitale des Archives du TPIR eu égard, notamment, à l'aboutissement de la mission de justice en général et, en particulier, de l'enjeu crucial ayant conduit à la création du TPIR.

Le processus judiciaire du TPIR a été institué par la résolution du Conseil de Sécurité des Nations Unies n° 955 du 08 novembre 1994. Au vu de la lettre de ladite résolution, la mission assignée au Tribunal Pénal International pour le Rwanda est double :

-                 punir les crimes internationaux ayant été perpétrés au Rwanda en 1994 ;

-                 aider le peuple rwandais à se réconcilier.

Force est de souligner qu'au-delà de l'objectif de poursuites et de répression des crimes commis au Rwanda et dans la région des Grands Lacs d'Afrique, le TPIR est d'abord et, avant tout, un cadre international où devait être passé au peigne fin l'histoire dramatique du Rwanda en vue de l'éclatement de la vérité, condition sine qua non pour une réconciliation véritable des fils et filles du Rwanda. Dans un processus aussi vital pour la nation, il est essentiel que toute la lumière soit faite sur le rôle des uns et des autres dans le drame qui s'est abattu sur le Rwanda depuis 1990 jusqu'à aboutir au génocide d'une partie de la population du pays. En tout état de cause, le Rwanda ne peut guérir de ses démons si un criminel ou un groupe criminel, ayant joué un rôle central dans le processus suicidaire du pays, reste aux commandes du pays.

Force est de rappeler que le Front Patriotique Rwandais a été de bout en bout un acteur-clé du drame rwandais. En effet, initiateur de la guerre qui a commencé le 1er octobre 1990 à partir de l'Ouganda, le FPR est sorti victorieux de la guerre et depuis, il a en charge les destinées du Rwanda. Cependant, le rôle occupé depuis le début de la crise rwandaise place le FPR dans une position délicate de juge et partie et, de ce point de vue, le FPR ne devrait pas être dépositaire de l'héritage du TPIR, Institution ayant géré l'histoire dramatique du Rwanda. En effet, pour s'assurer l'impunité totale et pour des raisons psychologiques évidentes, le gouvernement FPR refusera toujours que toute la lumière soit faite sur l'histoire dramatique du Rwanda et, de ce point de vue, lui confier les archives du TPIR serait compromettre définitivement le processus vérité et justice essentiel pour le peuple rwandais traumatisé. La neutralité du FPR ne peut être assurée, étant au départ et à l'arrivée du drame  qui s'est abattu sur le Rwanda.

Ainsi, au-delà de ces considérations de caractère général, il se dégage deux empêchements dirimants à ce que les archives du TPIR soient confiées au gouvernement rwandais dominé par le Front Patriotique Rwandais :

1.              La protection des témoins

On sait qu'un témoin peut être protégé à sa demande, à celle de l'Accusation, de la Défense, de la Section d'aide aux victimes et aux témoins ou des juges. Ainsi, devant différentes chambres du TPIR, il y a eu plusieurs types de témoins protégés : témoins sous pseudonyme, témoins autorisés à déposer totalement ou partiellement. Dans tous les cas, le nom des témoins protégés, ainsi que toute information permettant de les identifier, est supprimé des documents publics du Tribunal afin de préserver l'anonymat des témoins protégés. Toutes ces mesures visent à ce que l'identité du témoin, qui est toujours révélée à l'accusé et à son conseil, ne soit pas divulguée au public. Au regard de ce qui précède, c'est les Nations Unies qui doivent garder les archives du TPIR, car ces archives contiennent l'identification de milliers de témoins protégés qui, si leur identité est révélée au FPR, pourraient subir de graves conséquences. Ces observateurs privilégiés du drame rwandais qui, pour une question de sécurité, ont obtenu des garanties que leur identité ne sera pas divulguée au public, sont des acteurs du processus de justice pour le Rwanda et, comme tels, ne peuvent être révélés au FPR qui n'a jamais fait preuve de neutralité dans la gestion juridictionnelle du drame rwandais.

2.              Le défaut de neutralité du gouvernement rwandais

Lors de l'administration de la preuve devant les différentes chambres du TPIR et tout au long des débats, une masse de pièces à convictions, de témoignages factuels, de témoignages de contexte et de témoignages d'experts ont abondamment établi la responsabilité de la rébellion du FPR dans le cours des événements sanglants ayant secoué le Rwanda. Des témoins experts de la défense ont, entre autres, éclairé les différentes chambres du TPIR sur les choix politiques et stratégiques du FPR ayant transformé la guerre de libération nationale en un bain de sang. Voilà pourquoi le gouvernement dominé par le FPR a tout fait pour étouffer la vérité sur le cours de la guerre et les différentes étapes l'ayant fait parvenir à la victoire politique et militaire.

Ceci étant, le gouvernement dominé par le FPR, s'il recevait les archives, il ne pourrait pas s'empêcher de tripatouiller les différents dossiers pour extirper toutes les preuves de sa responsabilité dans le drame rwandais. Par ailleurs, non content que certains anciens dignitaires du régime Habyarimana aient été acquittés par le TPIR, le gouvernement ne s'empêcherait pas de relancer les poursuites dans des dossiers clôturés. On se souvient que dans plusieurs cas, le gouvernement rwandais a organisé des manifestations-monstres pour dénoncer les acquittements et, en même temps, lancer de nouvelles accusations contre des personnes fraîchement acquittées par le TPIR.

Pour toutes ces raisons, les FDU-Inkingi recommandent fermement de refuser catégoriquement au gouvernement rwandais toutes prétentions à la gestion des archives du TPIR.

RWANDA: FDU-INKINGI IS STRONGLY OPPOSED TO THE MANAGEMENT AND CONSERVATION OF ARCHIVES OF THE ICTR BY THE RPF, ONE OF THE PARTIES TO THE CRIMES COMMITTED IN 1994.

The Government of Rwanda Patriotic Front persists and intensifies the pressure to be entrusted with the archives of the ICTR. This request is far from being trivial. It is worth recalling the great importance of the Archives of the ICTR, particularly with regard to bringing about justice in general, and in particular the key aim of the creation ICTR.

The judicial process of the ICTR was established by the resolution of the Security Council of the United Nations nº 955 of 8 November 1994. In view of the objective of the resolution, the mission assigned to the International Criminal Tribunal for Rwanda is twofold:

  • Punish international crimes committed in Rwanda in 1994;
  •  Help the people of Rwanda to reconcile.

It must be emphasized that beyond the aim of prosecution and punishment of crimes committed in Rwanda and the Great Lakes region of Africa, the ICTR is first and foremost an international framework to carry out thorough investigation into the Rwandan tragedy and shed light on the whole truth about what happened, a prerequisite sine qua none for genuine reconciliation between sons and daughters of Rwanda. In such a vital process for the nation, it is essential that light be shed on the role of each actor in the tragedy that befell Rwanda right from 1990 to the genocide of one part of the country's population. In any case, Rwanda can only exorcise her demons if a criminal or a criminal group, which played a central role in the suicidal process of the country, keeps the reins of power of the country.

However, the delicate position of judge and jury that the RPF has occupied since the beginning of the Rwandan crisis rules it out from the position of being the custodian of the archives of ICTR, an institution that scrutinized the tragic history of Rwanda. Indeed, in order to ensure the total impunity and for obvious psychological reasons, the RPF government would be against the idea of shedding light on the tragic history of Rwanda. In case this is done the ICTR will have permanently jeopardized all hope for truth and justice so vital for the traumatized Rwandans. The neutrality of the RPF cannot be guaranteed, being part of the tragedy that befell Rwanda from the beginning to to the end.

Thus, beyond these general considerations, there are two compelling reasons why the ICTR archives should not be entrusted to the Rwandan government dominated by the Rwandan Patriotic Front:

1.              Witness protection 

We know that a witness may be protected at his/her request, the request of the Prosecution, the defence, the victims and witness support unit or of judges. Thus, there were several types of protected witnesses that came before different chambers of the ICTR: witnesses under pseudo names and witnesses who allowed to disclose totally or partially their identity. In all cases, the names of protected witnesses and any information that could identify them, was removed from the Tribunal's public documents to safeguard the identity of protected witnesses. All these measures are designed to ensure that the identity of the witness, which is always disclosed to the accused and his counsel, is not disclosed to the public. Given the above, it is the UN that must keep the archives of the ICTR, as these archives contain the identification of thousands of protected witnesses.  They could suffer serious consequences if their identity were revealed to the RPF. These privileged observers of the Rwandan tragedy, which for a security question, have obtained guarantees that their identity will not be disclosed to the public, are key actors in the process of justice for Rwanda and as such cannot be revealed to the RPF which has never been neutral in the judicial management of the Rwandan tragedy.

2.              Lack of neutrality of the Rwandan government

When the administration of evidence in the different chambers of the ICTR and throughout the debates, a mass of prosecution witness statements, factual evidence, testimonies on the context of the tragedy and expert testimony have clearly established the responsibility of the RPF rebellion in the bloody events that shook Rwanda. Defense expert witnesses, among others, informed the different chambers of the ICTR on political and strategic choices that turned the RPF war of national liberation into a bloodbath. That is why the government dominated by the RPF did everything to suppress the truth about the course of the war and the stages that led it to military and political victory.

That said, the government dominated by the RPF, if it received the archives, could not help but tamper with different files in order to remove all evidence relating to its responsibility in the Rwandan tragedy. Moreover, if not happy with the acquittal of the official of Habyarimana regime, the government could reopen closed cases for prosecution. We remember that in several cases, the Rwandan government organized massive demonstrations against the acquittals of some people and at the same time launched new accusations against people freshly acquitted by the ICTR.

For all these reasons, FDU-Inkingi strongly recommends that the request of the Rwandan government for the management of the ICTR archives be dismissed.
