Je sais ce que AIPAC signifie et l'erreur a déjà été corrigée sur DHR. Il faut lire avant de réagir.

Quant à la présence du Président Paul Kagame à cette conférence, elle est logique. Notre Président, qui entretient de bonnes relations avec les États-Unis et Israel, est devenu quasiment la seule personnalité Africaine incontournable pour s'exprimer, avec autorité, sur les affaires de ce monde.

Le Président Kagame avait déjà été l'un des rares Chefs d'Etat Africains a s'exprimer lors du Forum Economique de Davos; et à Washington, il donnera certainement sa vision du monde, y compris sur des questions de paix et de sécurité, et le rôle que l'Afrique doit jouer.

Voilà.

Witegereje neza, usanga Madamu Victoire INGABIRE yarakatiwe mbere y'uko anaburanisha rwose. Leta y'u Rwanda rero, ibonye itishimiye iki cyemezo ihita ihindura, ibyo kuva mu Rukiko irabireka, ahubwo itoresha umucamanza w'umunyarwandakazi mu kwa kalindwi 2016 ubwo Inteko y'Ubumwe bwa Afurika yari iteraniye i Kigali. RWANDA: LE PROCÈS DE LA PRÉSIDENTE DES FDU-INKINGI Mme VICTOIRE INGABIRE CONTRE L'ETAT RWANDAIS SE TIENDRA CE 22/03/2017 DEVANT LA COUR AFRICAINE DES DROITS DE L'HOMME ET DES PEUPLES

Les Forces Démocratiques Unifiées (FDU-INKINGI), Parti politique d'opposition au régime du Front Patriotique Rwandais (FPR) au pouvoir au Rwanda, portent à la connaissance du public que le procès de leur présidente, Mme Victoire INGABIRE, se tiendra contre l'Etat Rwandais, ce 22/03/2017 à 9h devant la Cour Africaine des Droits de l'Homme et des Peuples (CADHP) sise à Arusha en Tanzanie.

 Les FDU-Inkingi espèrent que le report au 22/03 du procès initialement prévu le 16/03 ne servira pas de   prétexte par Kigali pour ne pas comparaître devant la Cour.

La présidente des FDU-Inkingi est arrivée au Rwanda le 16/01/2010 en provenance des Pays-Bas, son pays d'exil, pour faire enregistrer son parti. Elle voulait également se présenter à l'élection présidentielle de 2010. Elle fut incarcérée suite au discours prononcé au Mémorial du génocide à Gisozi. Dans ce discours elle avait osé, pour la première fois, réclamer une justice pour tous. En effet, les crimes contre l'humanité commis au Rwanda contre les Hutu, n'ont jamais fait l'objet de jugement. Or, pour les FDU-Inkingi et pour Mme Victoire INGABIRE, une justice pour tous est la seule garantie d'une paix durable et d'une véritable réconciliation.

Comme il s'est avéré, Mme Victoire INGABIRE fut condamnée longtemps avant même son jugement. Pour rappel, le Président KAGAME a déclaré, le 23/03/2010 : " This woman will certainly be where she belongs (prison) ; now the outsiders who want so badly INGABIRE to be an opposition leader here or later be our President, well, they may wait for a while" = Cette femme sera certainement où elle doit être; maintenant, les étrangers qui veulent tellement INGABIRE comme leader de l'opposition ici ou par la suite comme notre Présidente, eh bien, ils peuvent attendre pendant un certain temps. » Le ton était solennellement donné.

Peu après, la condamnation d'avance de Mme Victoire INGABIRE fut reprise, publiquement, par Mme Louise MUSHIKIWABO Ministre des Affaires Etrangères et Mr Martin NGOGA Procureur Général du Rwanda. Mme Victoire INGABIRE fut donc condamnée le 30/10/2012 à 8 ans de prison par la Haute Cour de justice, et le 13/12/2013 à 15 ans de prison par la Cour Suprême du Rwanda.

Sa condamnation fut dénoncée par des organisations de droit de l'homme et le Parlement Européen:

AMNESTY INTERNATIONAL déclara : « The case of opposition party leader Victoire INGABIRE is the culmination of a flawed trial that included politically motivated charges = Le cas de la leader du parti d'opposition Victoire INGABIRE est l'aboutissement d'un procès inéquitable dont les accusations étaient fondées sur des motifs politiques ».

HUMAN RIGHTS WATCH « characterized the trial as unfair because the charges were political, the evidence was unreliable, INGABIRE was denied the presumption of innocence, and the judiciary was biased =  Human Rights Watch a caractérisé le procès d'inéquitable car les accusations étaient politiques, la preuve n'était pas fiable, Victoire INGABIRE s'est vue refuser la présomption d'innocence et le processus judiciaire était biaisé ».

Dans sa Résolution 2016/2910(RSP) du 06/10/2010, le PARLEMENT EUROPEEN : « Condamne fermement les procès politiquement motivés, la poursuite d'opposants politiques et l'issue décidée à l'avance du procès ; insiste sur le fait que les procès et les chefs d'accusation ne sauraient reposer sur des lois vagues et imprécises interprétées à mauvais escient, comme c'est le cas dans l'affaire Victoire INGABIRE ».

Ayant épuisé toutes les voies de recours intérieures, Mme Victoire INGABIRE a finalement eu recours le 03/10/2014 à la Cour Africaine des Droits de l'Homme et des Peuples sur base de l'article 34(6) de son Protocole. L'audience publique fut fixée 04/03/2016. Contre toute attente le 29/02/2016, le Rwanda fit une déclaration annonçant son retrait de la Commission pour lui permettre de revoir l'article 34 (6) du Protocole de la Cour, et demanda en même temps à la Cour de suspendre toutes les affaires impliquant le Rwanda devant elle, y compris l'affaire Victoire INGABIRE.

Prenant bonne note de cette déclaration, la Cour informe les parties de ce que l'audience publique se tiendrait comme prévue le vendredi 04/03/2016 à 9h00. Le Rwanda refusa à Mme Victoire INGABIRE de se rendre à Arusha, la privant ainsi du droit de se présenter devant ses juges. L'audience du 04/03/2016 eut donc lieu et la Cour entendit les avocats de la défense en l'absence de l'Etat Rwandais.

La Cour avait, au cours de sa 41ème session ordinaire le 03/06/2016, rendu publique sa décision AFCHPR/Reg/APPL. 003/2014/036, de lever la suspension dans l'Affaire n°003/2014 INGABIRE Victoire contre l'Etat Rwandais, en statuant : « La Déclaration spéciale de retrait faite par le Rwanda pour examiner l'Article 34 (6) est soumise à la notification d'une durée de 12 mois pour devenir effective ; elle n'affectera pas le procès dans l'Affaire INGABIRE ni ceux des autres affaires qui sont pendantes devant la Cour ».
 
Déçu par cette décision de la Cour, le gouvernement rwandais change de stratégie. Il renonce à son intention de retrait de la Cour et fait plutôt élire, en juillet 2016 par l'AG de l'Union Africaine réunie à Kigali, un juge rwandais au sein de la CADHP, en la personne de Mme Marie-Thérèse MUKAMULISA anciennement juge à la Cour Suprême. RWANDA: THE HEARING OF THE APPEAL OF "Mrs. VICTOIRE INGABIRE UMUHOZA AGAINST THE RWANDAN GOVERNMENT" BEFORE THE AFRICAN COURT OF HUMAN AND PEOPLES 'RIGHTS, DUE ON 22/03/2017

The Unified Democratic Forces (FDU-Inkingi), a political party opposed to the Rwandan Patriotic Front (RPF) regime in Rwanda, inform the public that the hearing of the appeal case before the African Court on Human and Peoples' Rights (ACHPR) of their president, Victoire Ingabire Umuhoza versus the Rwandan government, will take place on 22/03/2017 at 9 am in Arusha, Tanzania.

FDU-Inkingi hopes that the postponement of the hearing from March 16, 2017 to March 22, 2017 will not be used as a pretext by Rwandan government not to be represented at the African court on Human and Peoples' Rights.

FDU-Inkingi Party would like to recall that its President, Mrs Victoire Ingabire Umuhoza, arrived in Rwanda on January 16, 2010 from the Netherlands, where she lived in exile, to register her party and to stand in the 2010 presidential elections. She was imprisoned following a speech she made at the Genocide Memorial in Gisozi. In her speech, she dared, for the first time, demand justice for all.

Indeed, while she called for those who committed genocide against the Tutsi to be brought to book, she also demanded that the Tutsi who committed crimes against humanity and war crimes against the Hutu to be brought to justice as international and national laws stipulate. For FDU-Inkingi and Victoire INGABIRE, lasting peace and genuine national reconciliation are only possible if the law does not discriminate for or against anyone.

As we know now, Mrs. Victoire INGABIRE was condemned long before her trial. The message to this effect was passed on in a statement made by President KAGAME to a journalist of a Ugandan newspaper "The Monitor" on the 23rdof May 20110 in these terms: "This woman will certainly be where she belongs (i.e. prison); now the outsiders who want so badly INGABIRE to be an opposition leader here or later be our President, well, they may wait for a while".  Mrs. Louise MUSHIKIWABO Minister of Foreign Affairs and Mr. Martin NGOGA, Prosecutor General of Rwanda echoed the same message.

The message of President Kagame was acted on shortly afterwards. Mrs. Victoire INGABIRE, was arrested, detained, tried and sentenced on 30/10/2012 to 8 years' imprisonment by the High Court of Justice. When she appealed against her sentence, the sentence was increased to 15 years' on 13/12/2013 by the highest Court of Appeal, the Supreme Court of Rwanda.

The reasons for her conviction were denounced by human rights organizations and the European Parliament:

·         AMNESTY INTERNATIONAL noted: « The case of opposition party leader Victoire INGABIRE is the culmination of a flawed trial that included politically motivated charges », while HUMAN RIGHTS WATCH « characterized the trial as unfair because the charges were political, the evidence was unreliable, INGABIRE was denied the presumption of innocence, and the judiciary was biased ».

·         In its resolution 2016/2910(RSP) dated 06/10/2010, the EU parliament condemned "the politically motivated trials, the prosecution of political opponents and the prejudging of the outcome of the trial". It underlined the fact that "charges brought against the accused were based on vague and imprecise laws".

Having exhausted all domestic remedies, Victoire INGABIRE finally appealed to the African Court on Human and Peoples' Rights on 03/10/2014, based on Article 34 (6) of its Protocol. The public hearing was scheduled for 04/03/2016.

Against all odds on 29/02/2016, the Rwandan government through the Minster of Justice Mr Johnson Busingye made a statement which it sent to the African Commission on Human and Peoples' rights, with a copy to the African Court on Human and Peoples' Rights declaring that it no longer accepted provisions of the protocol establishing the African Court. It pointed out that it wished to review Article 34 (6) of the Protocol establishing the Court. In this vein, it requested the Court to suspend all the cases involving Rwanda before it, including Victoire INGABIRE case.

Taking note of this statement, the Court informed the parties that the public hearing would be held as scheduled on Friday 04/03/2016 at 9:00 am. Rwanda refused to allow Mrs. Victoire INGABIRE to go to Arusha, depriving her of the right to appear before her judges. The hearing went ahead on 04/03/2016. Defence lawyers were heard by the Court in the absence of the Rwandan State.

The Court, at its 41st ordinary session on 03/06/2016, issued its decision AFCHPR / Reg / APPL. 003/2014/036, in Case No. 003/2014 INGABIRE Victory against the Rwandan State, by the following ruling: "The Special Declaration of withdrawal made by Rwanda to consider Article 34 (6) is subject to notification of 12 months to become effective; It will not affect the trial in the INGABIRE Case or those of the other cases pending before the Court ".

Disappointed by this decision of the Court, the Rwandan government changed its strategy. It declined its intention to withdraw from the Court but succeeded in getting a Rwandan judge Mrs. Marie-Thérèse MUKAMULISA, former supreme court judge who was part of the panel of judges that sentenced Mrs Ingabire, elected as member of the African court. The election was done at the African Union Head of State Summit meeting that was hosted by the Rwandan government in Kigali – Rwanda in July 2016. Thus, the Rwandan government hopes, as a member of the African Court of Peoples' and Human Rights, to be judge and jury in the cases before the court against the regime, including the case of Victoire Ingabire Umuhoza.
