A Twitter hashtag hints at some uncomfortable truths.

News out of Rwanda this week is that only 10 Rwandans - in a country of 12 million, and 3.9 million registered voters - oppose President Paul Kagame's third term bid.

SOCIAL media can be a very inconvenient place.

News out of Rwanda this week is that only 10 Rwandans - in a country of 12 million, and 3.9 million registered voters - oppose President Paul Kagame's third term bid.

The country's lawmakers began a national tour last month to gather public opinions after both houses of Parliament voted in support of a constitutional amendment to allow Kagame a third shot at the presidency.

Out of the "millions" of Rwandans consulted on the amendment, "only 10 were against the idea", the New Times newspaper reported on Tuesday.

Meanwhile, in Kenya, #SomeoneTellKagame was the top trending topic on Twitter that very morning. It started Monday evening when a Kenyan, Levi Kones (@levikones) tweeted Kagame, "I really hope sir, you will not ruin your legacy by being President for life."

The response from Kagame's account (@PaulKagame) was swift, and brutal: "Worry more about your own legacy… if you got any at all to think about!!" (sic).

By morning, and in typical Kenyan fashion, Kenyans on Twitter had rallied to Kones' defence, under the hashtag #SomeoneTellKagame.

Le président ougandais Yoweri Museveni a critiqué lundi son homologue américain Barack Obama pour avoir laissé entendre que les dirigeants africains ne respectent pas la limitation de leur mandat présidentiel et s'accrochent au pouvoir toute leur vie. 

Lors d'une conférence de presse conjointe avec le président kenyan Uhuru Kenyatta à Entebbe, à 40 km au sud de la capitale ougandaise, Kampala, M. Museveni a déclaré que M. Obama et d'autres dirigeants occidentaux devaient respecter la volonté du peuple africain, qui élit "démocratiquement" ses dirigeants lors d'élections en bonne et due forme.

"Nous ne pensons pas que ceux qui pointent du doigt la limitation des mandats ont raison. L'Afrique n'est pas moins développée à cause de la limitation des mandats, mais à cause du manque d'unité, de marché commun, d'infrastructures et de l'insécurité", a-t-il indiqué.

"En Ouganda, nous organisons des élections tous les cinq ans et notre peuple a le choix. Nous allons organiser des élections ici et les Ougandais vous raconteront ce qu'ils pensent de la limitation des mandats", a ajouté le président ougandais.

Les députés ougandais ont voté en 2005 pour supprimer la limitation du nombre de mandats présidentiels fixée à deux mandats dans la constitution de ce pays d'Afrique de l'Est.

Dans un discours prononcé fin juillet devant l'Union africaine (UA) à son siège dans la capitale éthiopienne, Addis Abeba, le président américain avait appelé ses homologues africains à respecter leur constitution et à se retirer à la fin de leur mandat.

"Je ne comprends pas le phénomène des dirigeants qui refusent de se retirer quand leur mandat s'achève. Personne ne doit être président à vie", a-t-il déclaré.

M. Museveni a accédé au pouvoir en 1986 à la suite d'une guerre de cinq ans dans le centre du pays et présentera de nouveau sa candidature aux élections présidentielles en 2016 pour un cinquième mandat.

Pour sa part, M. Kenyatta a déclaré aux journalistes que la popularité du dirigeant d'un pays ne dépendait pas de la limitation du nombre des mandats.

"Si les Ougandais ont choisi de ne pas limiter le nombre de mandats, je ne vois pas le problème. Si telle est la volonté du peuple, il convient de s'y conformer. Nous devons respecter la volonté démocratique du peuple du pays ou de la région", a-t-il indiqué, avant d'ajouter : "Nous devons nous concentrer sur la prospérité de notre peuple, sur les infrastructures, l'unité et la sécurité".

This BBC analyst is reading and applying wrong law.

He's probably reading the EU Extradition Treaty instead of reading The EU Framework Decision of the European Arrest Warrant and the Surrender Procedure between Member States of 2002. The EU Extradition Treaty is/was among some European countries and does not originate from the Lisbon Treaty, therefore it does not enjoy " primacy" under the 2007 Treaty of Lisbon. Of course, the EU Extradition Treaty is binding to the States that signed it. However, under Declaration 17 of the Treaty of Lisbon, the EU Extradition Treaty does not prevail in KK's case because the UK is executing a European Arrest Warrant under the Treaty of Lisbon; The EU framework …of the European Arrest Warrants and the surrender procedure is Supreme under " primacy"!!

Dual criminality is not required under the EU framework …of the European Arrest warrants … of 2002. The EU Framework actually abolished extradition procedure among EU member States _( Refer to Article 1(1) and (5) of the Framework); it's surrender and the executing country is only providing practical and administrative assistance, Article 1 (9)

Article 1 (10), (12) and (13) of the framework provides the only three exceptions where implementation of the arrest warrants may be suspended. 

Assuming, arguendo, that dual criminality was a requirement under the European Arrest Warrant and the surrender procedure law " The Framework" of 2002, the BBC analyst should have noted that Article 2 (2) of The Framework which enumerates the crimes covered, provides that " all crimes within the jurisdiction of the ICC are covered". Assuming KK was charged with war crimes only, as the BBC analyst appears to argue, since war crimes fall under the jurisdiction of the ICC, then KK should have been surrendered to Spain since the Framework , Article 2 includes all crimes that fall under ICC jurisdiction among those that trigger transfer.

Article 3 of the Framework provides for mandatory non-execution of European Arrest Warrants – 3(1) where the suspect was granted amnesty for the same crimes, 3(2) where the accused was tried for the same crimes and the trial came to its natural end and 3(3) where one cannot be held criminally liable because of age, in the executing country. There are a number of grounds for optional non-execution of European Union arrest warrants under Article 4.

Dual criminality is not one of the applicable principles in KK's case. Therefore, the UK court could not have relied on this principle to set KK free. If this was the court's legal reasoning, I bet this case will go straight to the Court of Justice of the European Union for a long legal battle.
