La prestation de serment du président burundais réélu Pierre Nkurunziza a débuté ce jeudi à Bujumbura pour un troisième mandat controversé, dont la conquête a plongé son pays dans une crise politique émaillée de violences meurtrières, a annoncé son principal conseiller en communication.

"Ce 20 août, prestation de serment du Président élu, S.E. Pierre Nkurunziza au Palais des Congrès", a annoncé sur son compte Twitter ce conseiller, Willy Nyamitwe.

Cette cérémonie surprise a été annoncée à la dernière minute, pour des raisons de sécurité selon un membre du CNDD-FDD, le parti de M. Nkurunziza. Les journalistes de la Radio-télévision nationale burundaise (RTNB) n'ont été prévenus que dans la matinée, selon l'un d'eux.

Aucun chef d'Etat étranger n'était présent, ni aucun ambassadeur européen ou américain.

Selon la Constitution, le président élu prête serment auprès de la Cour constitutionnelle, devant les deux Chambres du Parlement réunies. Cette prestation marquera le début du 3e mandat, très controversé, de M. Nkurunziza, élu en 2005 par le Parlement, puis en 2010 et le 21 juillet dernier au suffrage universel direct.

Tensions et controverses

L'opposition, la société civile et l'Eglise catholique et une faction du parti de M. Nkurunziza, le CNDD-FDD, estiment que ce 3eme mandat est contraire à la Constitution et à l'Accord d'Arusha ayant ouvert la voie à la fin de la guerre civile (300 000 morts entre 1993 et 2006), qui limitent à deux le nombre de mandats présidentiels.

Les partisans du chef de l'Etat assurent eux que celui-ci ayant été élu la première fois au suffrage indirect, en vertu d'une disposition spéciale de la Constitution applicable au premier chef de l'Etat élu à l'issue de la transition post-guerre civile, son premier mandat n'entre pas en compte dans la limitation constitutionnelle.

Le président burundais a été investi, ce jeudi matin, lors d'une cérémonie dans la capitale Bujumbura, selon une source diplomatique européenne. Sa candidature pour un troisième mandat contesté a provoqué une crise dans le pays. La prestation de serment devait avoir lieu avant le 26 août, mais la date exacte n'était pas connue.

Burundi's foreign minister said his government is doing its best to ensure that the country does not degenerate into ethnic conflict by bringing those responsible for violence to justice. 

Alain Nyamitwe said President Pierre Nkurunziza has also promised to unveil a national unity government that will respect the Arusha Peace Accord and the recommendations of leaders of the East African Community (EAC).

His comments came after African Union Commission Chair Nkosazana Dlamini-Zuma warned Sunday that the political crisis in Burundi could have catastrophic consequences for the country and the surrounding region. Dlamini-Zuma also stressed the need for dialogue to find a peaceful and lasting solution to the current crisis.

Nyamitwe said Nkurunziza could unveil his new cabinet possibly as early as next week.

"What I can only say is that it is our hope and prayer that our country does not slide to the extent of collapsing into ethnized conflict. We are doing our utmost to make sure that the killings stop, that perpetrators are arrested and brought to book. I also agree that it is imperative to have different stakeholders get into deep discussion and conversation on the issues that divide them," he said.

Nyamitwe said, despite what some in the international community might think, there is some engagement with respect to the formation of a national unity government. He said Nkurunziza has made progress in putting together such a government.

"I can tell you that when [it] comes to the formation of the government of national unity, His Excellency, the head of state, has accepted to form such [a] government. The discussions are underway, and I can tell you that we are making progress. A few days from now you will be informed about the new cabinet. I can absolutely tell you that that government will comprise members from the ruling party, but also people from the opposition," Nyamitwe said.

The 2000 Arusha Accord, which ended Burundi's ethnic civil war, stipulates that 60 percent of members of parliament be from the majority Hutu ethnic group and 40 percent from the minority Tutsis. Three seats are designated to members of the Twa ethnic group. Women must occupy at least 30 percent of the seats in the National Assembly.

"As we speak, after the parliamentary elections which were held on [the] 29th of June, the 21st of July and the 24th of July, the parliamentary institutions, that is the House of Representatives and the Senate, have now been put in place and, in both bodies, the Arusha Accord has been fully respected and even beyond the quotas enshrined in our constitution," Nyamitwe said.

Nyamitwe criticized what he called some actors in the international community who he said think they have the right to lecture other nations on how they should govern.

"Some of those who are criticizing us do not respect the same quotas in their own institutions. How many women do you have in the parliament of the United States, or how many black people versus white people do you have in America?" he said.

Unidentified gunmen Saturday killed former military chief Jean Bikomagu outside of his home in the capital, Bujumbura. The death follows the recent assassination of the president's security advisor, Adolphe Nshimirimana.

In her statement Sunday, AU Commission chairwoman Dlamini-Zuma said, "This despicable act and multiple other acts of violence recorded in recent months illustrates yet again the gravity of the situation in Burundi - and the real risk of seeing a further deterioration with catastrophic consequences both for the country itself, and for the whole region."

Nyamitwe rejected any suggestion Burundi is descending into chaos. He said his government has condemned both assassinations.

    Vingt ans après le début de l'enquête, le parquet de Paris a annoncé, mercredi 19 août, avoir demandé un non-lieu pour le prêtre rwandais Wenceslas Munyeshyaka, mis en cause dans le génocide de 1994. L'homme s'était installé en 1995 en France, où il a été mis en examen. Selon le procureur de la République :

    « S'il ressort des investigations que le rôle de Wenceslas Munyeshyaka durant le génocide de 1994 a pu susciter de très nombreuses interrogations (...), l'instruction n'a pas permis, au final, de corroborer de façon formelle des actes précis et certains d'une participation active. »

    Il appartient, désormais, aux juges d'instruction d'ordonner ou non le renvoi devant une cour d'assises du prêtre, premier Rwandais visé par une plainte en France pour son implication présumée dans le génocide des Tutsi.

    Condamné à perpétuité au Rwanda

    Wenceslas Munyeshyaka est aussi le seul, avec son compatriote Laurent Bucybaruta, ancien préfet de la région de Gikongoro, à avoir été formellement accusé par le Tribunal pénal international pour le Rwanda (TPIR). Ce dernier a lancé un mandat d'arrêt contre lui en 2007. L'année précédente, les autorités judiciaires rwandaises avaient condamné le Père Munyeshyaka par contumace à la prison à perpétuité.

    En France, en revanche, le jugement a mis énormément de temps à se mettre en place depuis sa mise en examen en 1995. Si bien que la Cour européenne des droits de l'homme a condamné la France en 2004 pour sa « méconnaissance du principe du délai raisonnable » dans l'instruction de l'affaire.

    A la suite d'un portrait publié en 2010 dans Le Monde, le prêtre s'était défendu dans une lettresur son rôle au moment du génocide rwandais :

    « A Kigali, au moment des événements d'avril à juillet 1994, j'étais vicaire de la paroisse de la Sainte-Famille et j'ai accueilli dans ses locaux un grand nombre de réfugiés tutsi qui, désemparés et affamés, fuyaient les combats de l'est du pays et ne savaient ni où se loger ni où se nourrir. Avec de très grandes difficultés, j'ai essayé du mieux que je le pouvais de leur porter aide et assistance (...).

    J'ai effectivement quitté Kigali et la paroisse de la Sainte-Famille au début du mois de juillet 1994, car je fuyais à la fois les éléments du Front patriotique rwandais (FPR) qui entraient dans la capitale et voyaient en tout Hutu un extrémiste, et les miliciens hutu extrémistes eux-mêmes qui ne me pardonnaient pas d'avoir apporté des soins à des réfugiés tutsi. 

    J'ai été accueilli en France par la Conférence des évêques et j'ai occupé des fonctions sacerdotales en Ardèche d'abord, puis dans l'Eure. Je ne me suis jamais caché. »
